Important – Oriflame Direct Selling Guidelines

We value you as our business associate and we would like to apprise you that the Ministry of Consumer Affairs, Food & Public Distribution, Department of Consumer Affairs, Government Of India had issued the model Direct Selling Guidelines vide gazetted notification No. G.S.R 1013 (E) dated 26th October 2016 (“Guidelines”) to protect the interest of the consumer and industry. In the Guidelines the Government has fixed the responsibilities of the Company and its Consultant (Direct Sellers) to conduct the Direct Selling business in fair and ethical manner. It is the responsibility of every Consultant to strictly adhere to the provisions of the Guidelines and implement the same in their regular course of business. The Company has made the following changes in accordance with the Guidelines and the same will be implemented with immediate effect.

Based on the Guidelines please find below the following changes that are being implemented by the Company to ensure compliance with immediate effect:

1. Starter Kit: It is not mandatory to purchase starter kit/business kit in order to join Oriflame as a Consultant. However, the business kit is available to the Consultants as an optional purchase.
2. Address and ID Proof: All Consultants will be required to provide self-attested Address and ID proof (“Proofs”). The Consultants can provide any one of the following Proofs:
  1. Adhaar Card
  2. Voters Identity Card
  3. Passport
  4. Driving License
3. Existing Consultant and new consultant who join on or before 31 January 2017 can submit a copy of their self-attested Identity and Address Proof (i.e. physically sign the copy of the proof before scanning and mention consultant number on it) by any of the following means:
  1. Email: Email a copy of self-attested Proof with Consultant Number mentioned on it and send it to document.india@oriflame.com
  2. Courier: To COE-Head
    Oriflame India Pvt. Ltd.
    Ground Floor, Corporate One
    Plot No. 5, NHCC Jasola
    New Delhi: 110076
4. Existing Consultants shall be provided a period until 29th April 2017 to submit the proof failing which your ordering facility may be temporarily suspended. It is clarified that document should reach us by 29th April 2017, 18:30 hrs. Consultant have an option to update their KYC address online in their Profile page until 31st January 2017.
5. New Consultants who join on or after 1st February 2017 can submit a copy of their self-attested Identity and Address Proof (i.e. physically sign the copy of the proof before scanning and mention consultant number on it) by any of the following means:
  • Online/ Oriflame Web Page: upload a Jpeg or PDF scan copy of your Proof after login into your account (Profile page> general account setting), (Please note that for the purpose of uploading the Proof online on your profile page, the file should not exceed 1 MB size)
  • Beauty App: You can also take a picture of your self attested proof and upload in your Profile page> general account setting via the beauty app from your mobile handset
6. Oriflame ID Cards: Every Consultant is required to carry an Oriflame Identity Card and accordingly Oriflame will issue provisional Oriflame ID Cards to each of its consultants which will be available for download on your profile page (Profile page> general account setting) on Oriflame website after login (w.e.f 17th Jan 2017). For the new consultant who join after 1 Feb 2017, the provisional Oriflame ID Cards will also be sent on their registered email ID as a part of the welcome email. All existing consultant can download the Oriflame ID Card, it is already available on your profile page (Profile page> general account setting).
  • The Permanent ID Card will be generated on your profile page once your Proof is received and verified by Oriflame.
  • Please carry your Oriflame ID Card and 1 government recognized ID Card with you every time you visit Oriflame branch and while conducting your Oriflame business including but not limited to selling Oriflame products and prospecting.
  • The Oriflame ID card will have a validity period of 1 year (i.e. till 31st December each year) and it will be the responsibility of the Consultant to download a fresh ID Card after expiry of the old from their profile page.
7. Auto Termination: Your membership as Consultant will expire if you have not placed any BP order for a consecutive period of 2 years (previously 5 years) from the date of last BP order placed. Further, w.e.f 1st Feb 2017, all new registration will be terminated if BP order is not placed within 60 days of joining. However, they can re-join Oriflame very next month under sponsor of their choice.
8. Cooling off Period:  Remains same as per existing rule.
9. Buy Back: Oriflame stands for the quality of its products. If for any reason you are not completely satisfied with the products, you may return it within 30 days of the date of purchase as per the terms of the Guarantee of Excellence Claims Policy. If products are returned by customers directly to Oriflame, necessary adjustment shall be done from the respective Consultants account and any excess amount paid shall be recoverable from respective Oriflame Consultant. 10. E-commerce: No Consultant can sell Oriflame products on e-commerce website. Its illegal to sell on Flipkart, Amazon etc. Don’t do this, if you do, you will be in big trouble. You can see… Online Selling of Oriflame Products Not Allowed
11. Statutory Compliances: Every consultant shall be responsible for complying with the applicable laws in the state in which he conducts the Oriflame business including taking any registration, paying VAT and other applicable taxes, etc.
12. Training and Prospecting: We would also like to draw your attention to the Training manual you need to refer in soliciting and prospecting a new consultant. It is an obligation of all Consultants to follow the instruction provided in the training manual and use the same as a basis for explaining the business opportunity to the new prospect.

As a part of the Training Manual we have specified the following requirement in line with the Guidelines to ensure that you are able to explain the Direct Selling Business, Oriflame Business opportunities and their rights, obligations as Oriflame Consultants including benefits to the prospect in clear and correct manner. Following are the important instructions you need to note and follow as a Consultant:

  1. Consultant shall buy products depending upon their consumption requirements or selling pattern and in such quantity and value that can be foreseen to be sold to consumers or consumed within a reasonable period of time
  2. Consultant shall keep proper books of accounts stating the details of the products, price, tax and the quantity and such other details in respect of the goods sold by him / her, in such form as per applicable law
  3. The Oriflame Consultants shall not use misleading, deceptive and/or unfair trade practices or use misleading, false, deceptive and/or unfair recruiting practices, including misrepresentation of actual or potential sales or earnings and advantages of direct selling, business opportunities, to any prospective direct seller, in their interaction with prospective direct seller.
  4. The Oriflame Consultants shall not make any factual representations to a prospective direct seller that cannot be verified or make any promise that cannot be fulfilled
  5. The Oriflame Consultants shall not knowingly make, omit, engage, or cause, or permit to be made, any representation relating to the direct selling operation, including remuneration system and agreement between Oriflame and itself which is false and / or misleading.
  6. The Oriflame Consultant shall not require or encourage direct sellers recruited by the first mentioned direct seller to purchase Oriflame Products in unreasonably large amounts
  7. The Oriflame Consultant shall not provide any Oriflame Literature and / or training materials not restricted to collateral issued by Oriflame, to a prospective and / or existing direct seller which has not been approved by the Oriflame
  8. The Oriflame Consultant shall not require prospective or existing direct Sellers to purchase any Oriflame Literature or training materials or sales demonstration equipment
  9. Offer the prospective consumer accurate and complete explanations and demonstration of the Oriflame Products, prices, terms of payment, terms of guarantee.
  10. No Consultant shall sell in, demonstrate or display Oriflame products in any retail outlet of any nature including any retail/e-commerce website, whether in India or abroad unless you have a prior written consent from Oriflame
  11. Every Oriflame Consultant shall inform the consumer of the order date, the total amount to be paid by the consumer and provide him a bill and receipt;
13. Grievance Redressal Committee: We are also pleased to inform you that, the Company has formed a Grievance Redressal Committee for reviewing and resolving consumer and consultant complaints relating to Oriflame Products and Code of Ethics. All the mails/ complaints related to the Oriflame products should be raised under the Claims portal or sent to Contact Center at contactcenter.india@oriflame.com or Contact at 011-40409000 or 011-66259000. For COE related complaints, you are required to contact the Area Manager / Senior Area Manager of your nearest / Catering Branch.
14. Duties of Oriflame Consultant: It is your responsibility as a Consultant to share the following information at the time of sale of Oriflame Products to the customer/ consumer:
  1. Your Name, Address, registration number or enrolment numbers, identity proof and telephone number and details of Oriflame
  2. Descriptions of the goods or services to be supplied
  3. Explain to the consumer about the goods return policy of Oriflame in detail before the transaction
  4. The order date, the total amount to be paid by the consumer along with the bill and receipt;
  5. Time and place for inspection of the sample and delivery of goods
  6. Information of his/her rights to cancel the order and / or to return the product in saleable condition and avail full refund on sums paid
  7. Details regarding the complaints redressal mechanism;
15. Terms & Condition: The Terms and Conditions in the CAF, Code of Conduct and other documents and policies have been amended after incorporating the necessary changes based on the Guidelines as explained above. Further, every consultant shall be required to provide their acceptance to such amended Terms and Conditions if they wish to continue their membership with Oriflame. The same will appear as a Pop-Up, the moment you log-in into your Oriflame account. You can give your acceptance to the same by clicking on the “I Accept” Tab. Every consultant joining on and after 1st Feb 2017 has to accept T&C by loging into website before placing any order.

We reiterate that it is your responsibility as a Consultant of Oriflame to comply with all requirements of the Direct Selling Guidelines mentioned above and also adhere to the Statutory Compliances applicable to the state in which you conduct your Oriflame business. Let’s work together and comply independently with all respective laws as may be applicable.
